1. Introduction

These Terms and Conditions govern access to and use of Hapus Hub Online operated by Hapus Yogi trading as Hapus Hub, a sole trader registered in the United Kingdom.

By purchasing a membership or accessing any content within Hapus Hub Online, you agree to be legally bound by these Terms and Conditions. If you do not agree, you must not use the platform.

These Terms and Conditions are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales.

2. Nature of the Service

Hapus Hub Online provides digital content including but not limited to yoga practices, meditation sessions, breathwork, relaxation practices, educational materials, written articles, recipes, podcasts, masterclasses and related wellbeing content.

All content is provided for general educational and informational purposes only.

Hapus Hub Online does not provide medical advice, psychological therapy, physiotherapy, psychiatric services, counselling, diagnosis, treatment or any regulated healthcare service.

Nothing on this platform constitutes medical advice or a substitute for professional medical care.

3. Health and Medical Disclaimer and Assumption of Risk

Participation in yoga, movement, breathwork and related practices involves inherent physical and psychological risks including but not limited to musculoskeletal injury, dizziness, emotional release, changes in breathing patterns, and aggravation of pre existing conditions.

By using this platform, you confirm and agree that:

  • You are voluntarily participating in all activities.

  • You are physically and mentally fit to participate.

  • You have sought and obtained medical advice where appropriate before commencing participation.

  • You will not participate if advised against doing so by a qualified medical professional.

  • You accept full responsibility for monitoring your own condition during participation.

  • You will immediately cease activity if you experience pain, discomfort, dizziness, distress or adverse symptoms.

Certain breathwork or nervous system practices may induce altered breathing patterns, emotional release, temporary changes in mood or heightened psychological sensitivity. 

By accessing and participating in any content on Hapus Hub Online, you expressly acknowledge and agree that:

  • You are voluntarily participating in activities that involve inherent risks.

  • You understand the nature of these risks.

  • You assume full responsibility for any injury, loss or damage which may arise.

  • You are solely responsible for determining whether participation is appropriate for you.

  • You have consulted a qualified medical professional where necessary prior to participation.

  • You will not participate if you have been advised against such activity by a healthcare provider.

  • You further agree that you are responsible for ensuring that you have a safe environment in which to participate, including adequate space, appropriate flooring and suitable equipment where relevant.

If you are pregnant, postnatal, recovering from surgery or injury, living with a diagnosed condition, taking medication that may affect your capacity to exercise or regulate your nervous system, or have any concerns about suitability, you must obtain professional medical clearance prior to participation.

4. Questionnaire and Content Recommendation Disclaimer

Hapus Hub may provide content recommendations based on information submitted through questionnaires or self reported responses.

These recommendations are automated or practitioner guided suggestions intended solely to help members navigate available content.

Recommendations are based entirely on the accuracy and completeness of information provided by the member.

Such recommendations do not constitute medical advice, diagnosis, treatment, therapeutic intervention or personalised healthcare.

They do not remove or replace the requirement to obtain approval from a qualified medical professional.

Members remain solely responsible for determining whether any content is suitable for them.

5. International Access

Hapus Hub Online is operated from the United Kingdom.

Members accessing the platform from outside the United Kingdom do so at their own initiative and are responsible for compliance with local laws and regulations in their country of residence.

Nothing within these Terms creates jurisdiction in any territory other than England and Wales.

6. Membership, Billing, Payments, A Refund Policy

Membership fees are payable in advance on a monthly or annual basis as selected at the time of purchase.

All fees are non refundable except where required by law. 

You may cancel your membership at any time. Cancellation prevents future payments but does not entitle you to a refund for the current billing period.

Digital content is delivered immediately upon purchase. By purchasing membership, you acknowledge that you waive any statutory cooling off rights once access has been granted, except where consumer law requires otherwise.

Hapus Hub reserves the right to amend pricing with reasonable notice.

7. Intellectual Property

All content within Hapus Hub Online including videos, audio recordings, written materials, branding and course materials remains the intellectual property of Hapus Hub.

Members are granted a non transferable, non exclusive, revocable licence for personal use only.

You must not copy, reproduce, distribute, record, share, sell, modify or publicly display any content without prior written consent.

Unauthorised sharing of login details or content access is strictly prohibited and may result in immediate termination of membership without refund.

8. Code of Conduct

Members agree to engage respectfully within any community features, live sessions or discussion spaces. 

Harassment, discrimination, abusive behaviour or inappropriate conduct will not be tolerated and may result in termination of access.

9. Limitation of Liability

To the fullest extent permitted by law, Hapus Hub and its representatives shall not be liable for any direct, indirect, incidental or consequential loss or damage arising from:

  • Use of or inability to use the platform

  • Reliance on any content

  • Injury sustained during participation

  • Technical interruptions or service outages

Nothing in these Terms limits liability for death or personal injury caused by negligence where such limitation would be unlawful.

To the fullest extent permitted by applicable law, you hereby irrevocably release, waive, discharge and hold harmless Hapus Hub, its owner, employees, contractors, guest practitioners and representatives from any and all claims, liabilities, demands, actions, causes of action, damages, losses or expenses, whether known or unknown, foreseen or unforeseen, arising out of or connected with:

  • Your participation in any content provided through Hapus Hub Online.

  • Your reliance on any information, guidance or recommendation provided.

  • Any injury, illness, psychological impact, loss or damage sustained during or after participation.

  • Any failure to obtain appropriate medical advice prior to participation.

This release applies to claims based on negligence to the fullest extent permitted by law, except where liability cannot legally be excluded under the laws of England and Wales.

You acknowledge that this waiver is intended to be interpreted as broadly and inclusively as permitted by law. If any portion of this clause is held invalid, the remainder shall continue in full force and effect. 

10. Data Protection

Personal data is processed in accordance with the UK General Data Protection Regulation and the Data Protection Act 2018.

Members are responsible for ensuring that information provided is accurate and up to date.

11. Amendments

Hapus Hub reserves the right to update these Terms and Conditions at any time. Continued use of the platform following amendments constitutes acceptance of the revised Terms.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

13. Explicit Waiver and Release of Liability

To the fullest extent permitted by law, you agree to release, waive and discharge Hapus Hub, its owner, employees, contractors and representatives from any and all claims, demands, causes of action, liability, loss, damage or expense arising from or connected to your participation in any content provided through the platform.

This includes claims arising from negligence, except where liability cannot legally be excluded under the laws of England and Wales.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence where such limitation would be unlawful. 

14. No Emergency Services

Hapus Hub does not provide emergency or crisis services.

If you are experiencing a medical or mental health emergency, you must contact your local emergency services provider immediately.

The platform is not monitored for urgent communications and must not be used as a substitute for immediate professional assistance.

15. Age Restrictions

Membership is available only to individuals aged eighteen years or over.

By using the platform, you confirm that you are at least eighteen years of age and legally capable of entering into a binding agreement.

16. Indemnity

You agree to indemnify and hold harmless Hapus Hub from and against any and all claims, liabilities, damages, losses or expenses, including legal fees, arising from:

  • Your breach of these Terms.

  • Your misuse of the platform.

  • Your participation in content against medical advice.

  • Any third party claim arising from your actions or use of the platform.

17. No Guarantee of Results

Hapus Hub makes no representations or warranties regarding specific physical, psychological or personal outcomes. Individual results will vary and are influenced by numerous factors beyond the control of Hapus Hub.

Participation does not guarantee improvement in physical health, mental wellbeing, emotional regulation or any other specific outcome.

18. Entire Agreement

These Terms constitute the entire agreement between Hapus Hub and the member in relation to use of the platform. 

Privacy policy

Hapus Hub is committed to protecting your personal data in accordance with UK data protection legislation.

Personal data collected may include name, email address, payment details, questionnaire responses and usage data.

Data is collected for the purposes of providing membership services, processing payments, improving content recommendations and communicating with members.

Payment information is processed securely via third party payment providers. Hapus Hub does not store full card details.

You have the right to access, rectify, erase or restrict processing of your personal data, subject to legal obligations.

Data may be stored outside the United Kingdom where service providers operate internationally. Appropriate safeguards will be used.

Data will be retained only as long as necessary to fulfil contractual and legal obligations.
